GIORDANOS DOES NOT WARRANT THAT OUR FOOD PRODUCTS ARE FREE FROM ALLERGENS OR THAT THEY ARE SUITABLE FOR INDIVIDUALS WITH SPECIFIC DIETARY REQUIREMENTS, RESTRICTIONS, OR MEDICAL CONDITIONS. OUR FOOD PRODUCTS ARE PREPARED IN FACILITIES THAT HANDLE COMMON ALLERGENS INCLUDING BUT NOT LIMITED TO GLUTEN, DAIRY, EGGS, NUTS, SOY, SHELLFISH, AND FISH. IT IS YOUR SOLE RESPONSIBILITY TO INFORM OUR STAFF OF ANY ALLERGIES OR DIETARY RESTRICTIONS BEFORE ORDERING. EXCEPT FOR CLAIMS FOR INJUNCTIVE OR OTHER EQUITABLE RELIEF, ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, OR THE BREACH, TERMINATION, OR INVALIDITY THEREOF, SHALL BE SETTLED BY BINDING ARBITRATION IN ACCORDANCE WITH THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION ("AAA"), INCLUDING THE AAA'S CONSUMER ARBITRATION RULES WHERE APPLICABLE. THE ARBITRATION SHALL BE CONDUCTED IN THE ENGLISH LANGUAGE. THE ARBITRATOR'S AWARD SHALL BE FINAL AND BINDING AND MAY BE ENTERED AS A JUDGMENT IN ANY COURT OF COMPETENT JURISDICTION.

The arbitration will be conducted by a single arbitrator. The arbitrator will have the authority to award any remedy that would be available in court. The Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs the interpretation and enforcement of this arbitration agreement.

10.3 Class Action Waiver

YOU AND GIORDANOS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. UNLESS BOTH YOU AND GIORDANOS AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

10.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court in the jurisdiction where you reside, provided that the dispute qualifies for small claims court jurisdiction and remains in small claims court and is not removed or appealed to a court of general jurisdiction.

11. Term and Termination
